1. Acceptance of Terms
By inviting, installing, configuring, or interacting with our Bots — or by using features on arkadeonline.com that depend on those Bots — you agree to these Terms. If you do not agree, do not use the Bots.
You also agree to comply with Discord’s Terms of Service, Community Guidelines, and Developer Policies. If there is a conflict between Discord’s rules and these Terms, Discord’s rules control for activity on Discord’s platform.
2. Description of Service
ARKADE provides Discord bots and related community tools that may include (depending on configuration) moderation helpers, role and channel automation, event utilities, notifications, account-linking helpers, economy/reward integrations, and other gaming community features. Features may change, be limited, or be discontinued at any time.
3. Eligibility
You must meet Discord’s minimum age requirements and any applicable local laws to use the Bots. If you configure a Bot for a Discord server, you represent that you have authority to add integrations to that server and to authorize processing of server data as described in our Privacy Statement.
4. Acceptable Use
You agree not to use the Bots to:
- Violate Discord’s Terms of Service, Community Guidelines, or Developer Policies
- Harass, abuse, threaten, or harm others, or facilitate illegal activity
- Spam, raid, scrape, or overload Discord APIs or our infrastructure
- Attempt to bypass rate limits, security controls, or permission systems
- Reverse engineer, exploit, or interfere with Bot operation except as allowed by law
- Use Bot features to collect personal data unlawfully or without appropriate notice to your server members
- Impersonate ARKADE staff or misrepresent affiliation with ARKADE
We may suspend or revoke Bot access for servers or users that violate these Terms or pose a risk to our community or systems.
5. Server Administrator Responsibilities
If you administer a Discord server using our Bots, you are responsible for:
- Configuring permissions, channels, and roles appropriately
- Informing your members about Bot features that process their data where required
- Using moderation and automation tools lawfully and in good faith
- Keeping API tokens, webhooks, and privileged access under your control secure
6. Accounts, Rewards, and Community Features
Some Bot features may interact with ARKADE community records (for example linked accounts, votes, rewards, or in-game integrations). Those features may have additional rules published in our Discord or on our website. We may adjust balances, revoke rewards, or correct records in cases of abuse, error, or exploit.
7. Intellectual Property
ARKADE retains all rights in the Bots, branding, software, and related materials, except for third-party content (including Discord trademarks and your own user content). You may not copy, redistribute, or commercially exploit the Bots without our prior written permission.
8. Third-Party Services
The Bots rely on Discord and may integrate with other third-party services. We are not responsible for third-party outages, policy changes, or actions outside our control.
9. Disclaimer of Warranties
THE BOTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Bots will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARKADE AND ITS TEAM MEMBERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE BOTS. Our total liability for any claim relating to the Bots will not exceed the greater of (a) the amount you paid us for the Bot service in the 12 months before the claim (if any) or (b) USD $50.
11. Indemnification
You agree to indemnify and hold harmless ARKADE and its team from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Bots, your server configuration, or your violation of these Terms or applicable law.
12. Suspension and Termination
We may suspend or terminate Bot access for any server or user at any time, including for Terms violations, security risks, abuse, or operational reasons. You may stop using the Bots at any time by removing them from your Discord server and discontinuing interactions.
13. Changes to These Terms
We may update these Terms from time to time. The “Effective date” at the top of this page will reflect the latest revision. Continued use of the Bots after changes become effective constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the United States and the State of California, without regard to conflict-of-law principles, except where mandatory local consumer protections apply. Courts located in California will have exclusive jurisdiction over disputes arising from these Terms, to the extent permitted by law.
